Below are the terms and conditions that have been carefully crafted to protect both you ("the Client") and us ("The Winstons Agency LLC"). We strongly recommend reviewing these terms prior to booking or engaging with us for any projects. Please note that all terms and conditions are subject to revision. Last updated: December 2024.
PAYMENTS & DEPOSITS
At The Winston Agency, all pricing is subject to change at any time and becomes effective immediately upon posting to our site. If an agreed price has been set with a client prior to a price change, the original price will remain valid for that project until completion.

For projects under $300: Full payment is required upfront before any work begins.

For projects over $300: A non-refundable deposit is required to begin work. The remaining balance must be settled before final files are delivered. Payment plans are available upon request.
All payments should be made via the method specified by The Winston Agency. Accepted payment methods include debit/credit cards, Apple Pay, and Zelle. If using Apple Pay or Zelle, please contact us before booking to confirm. No project will begin without receipt of payment.
All Sales Are Final.
PROJECT TURNAROUND TIMELINE
Project timelines begin the next business day after the Client Design Form is completed and all required information is received. Each project has its own specific turnaround time; please refer to the service details or contact us for clarification.

Design Revisions: The standard turnaround time does not include revisions, which may take an additional 3-7+ business days, depending on the service.

Delays: Turnaround times may be extended due to unforeseen circumstances such as emergencies, illness, technical issues, or other uncontrollable factors.
Finalized artwork files will not be delivered until the full payment is made.
Note: Designs may be sent outside of business hours, but turnaround times are still counted in business days.
REFUNDS & CANCELLATIONS
Due to the nature of our services, The Winston Agency does not offer refunds. ALL SALES ARE FINAL, and all payments or deposits made are non-refundable. Once payment is processed, the sale is considered complete. If you choose to cancel your order, it will be forfeited, and the design process will cease immediately. No reimbursements will be provided.
In the rare event that an issue arises on The Winston Agency's end, any refund or payment adjustments will be determined at our discretion. If fraud disputes are filed for fulfilled orders, they will be addressed through legal channels.
DRAFT & REVISIONS
We offer two rounds of revisions per project. After the second revision, any additional changes will incur a fee of $10 - $50 per revision. Revisions include, but are not limited to, font changes, color adjustments, and resizing.

Revision Timeline: Revisions take 3-7+ business days and are not included in the initial turnaround time.

Ownership: All drafts and preliminary designs remain the property of The Winston Agency. They may not be used in any form unless expressly authorized.
CLIENT COMMUNICATION
We operate under a "No Disturb" policy during the design process. To deliver the best results, we require uninterrupted focus. You will receive your initial design preview on a business day as outlined in your order.

Response Time: Emails and messages will be responded to within 48 business hours. During peak times, there may be delays.

Branding Packages: If you’ve purchased a full branding package, you will have scheduled virtual meetings and deadlines. These will ensure smoother communication and a more collaborative experience.
CONTENT ACCURACY
The Winston Agency is not responsible for any spelling errors, grammatical mistakes, or missing information. All content submitted for design must be proofed by you. No changes will be made after design approval unless a revision fee is paid.
Communication: For accuracy and documentation purposes, all communication must be conducted through email or our CRM platform.
PROJECT ABANDONMENT
Failure to complete the Client Design Form and submit all required information within 30 business days will result in order termination and a $50 restart fee. If designs are started but not finalized within 45 days, the project will be forfeited, and no refund will be issued.
FINAL FILE DELIVERY
Upon final approval of designs, you will receive the completed files in PDF, PNG, SVG, and JPG formats. A $30 fee will apply for additional adjustments after the final designs are sent
USAGE RIGHTS
Once full payment is received, you are granted the rights to use the designs across all business platforms. The Winston Agency reserves the right to showcase the design for promotional use.
CLEAR VISION
To ensure the most efficient and effective design process, we strongly recommend having a clear vision in place prior to booking. A well-defined vision helps minimize revisions and streamlines the overall workflow. While we are here to guide and collaborate with you, it’s crucial that your brand’s goals and messaging are clearly articulated from the start. Clear direction from the outset prevents miscommunication and ensures that the process remains on track, avoiding unnecessary delays or frustration.
TERMINATION
If your order is terminated due to misconduct, The Winston Agency reserves the right to stop work immediately. This includes rude behavior, disrespectful communication, or failure to provide necessary materials on time. Such actions are not acceptable and are detrimental to the collaborative process.
HOURS OF OPERATION
The Winston Agency's business hours are Monday through Friday, from 8:00 AM to 4:00 PM (CST). Please note that business days do not include weekends, holidays, or any days we announce as closed. Clients who reach out outside of business hours may receive a response, but if not, they will be replied to on the next business day.
All messages are typically responded to within 48 business hours; however, during peak times, response times may be delayed.
